Obersturmbannführer (Lt. Col.) Karl Adolf Eichmann (1906-1962)

After the "Wannsee Conference" in January 1942 in Berlin his duties in the National Socialist regime became issues related to the Final Solution of the Jews in Europe. He assumed the leading role in coordinating the deportation of Jews from every corner of Europe to existing ghettos in occupied Poland and to newly constructed gas chambers at places such as Sobibor, Chelmno, Treblinka and Auschwitz-Birkenau.

The extremely historic lot consists of three items: 

1. the original court documents from Eichmann's defending lawyer

2. a stationary from the lawyer (Dr. Servatius) dated 1979 and hand signed

3. A rare book, written and published from Dr. Servatius about the trial of one of the most wanted Nazis in Israel. The book contains a lot of notes the lawyer took when he spoke with Eichmann and was printed only in a small number.

The other set of these documents are in the National Archives in Israel!

The whole document contains 97 pages, it was mailed from Dr. Servatius to a Mrs. E.Merzinger in Cologne, probably a coworker of the Servatius, the lawyer and defender of Adolf Eichmann. The unique document has a handwritten dedication to this person on the cover sheet and the original signature of the lawyer. The document is dated 14 August 1961, the same day as the pleading. The document contains of the following three chapters:

1. introductory representations, dated 10 April 1961

2. comments of the defense, dated 14 April 1961

3. pleading of the defense, dated 14 August 1961

this original signed stationary from the lawyer which accompanied the documents when Dr. Servatius send them to Mrs. E. Metzinger, both with addresses in Cologne, Germany.

the first page of the defense statement, dated Jerusalem 10 April 1961 in which Dr. R. Servatius questions that the court is impartial and that it is mainly a trial of revenge... (the paper is not that yellow, only the picture is bad, sorry)

on page 34 the lawyer tries to solve how much his client can be considered responsible for the killing of the Jews in the death camps because he was in charge of organizing to get them there, trainload by trainload.

page 32 deals about Eichmann's role as the one who directed all the trainloads of Jews from all over Europe to the gas chambers in the East from his office in Berlin. The lawyer writes that it was not Eichmann but SS leader Reinhard Heydrich and his boss, Müller who were in charge of the resettlement of the Jews until the war against Russia had started. Then Eichmann took over and became the head of the office.

The court accuses Eichmann to have received a direct order from Hitler to work out the plan to determinate all Jews in Europe and Russia and that he is the main one responsible (after Hitler and Heydrich are dead). The lawyer denies this and writes that there is no evidence in existance.

On this page the lawyer makes a statement that it is incorrect that his client (Eichmann) had ordered the use of the Zyklon B to gas the Jews in Auschwitz. The former commander of Auschwitz, Hoess states that his right hand, Fritsch, found out by accident about the usefulness of Zyklon B... There is also no evidence which proves that Eichmann gave Hoess the order to kill the Jews in Auschwitz in the summer of 1941. (Hoess accused Eichmann in November 1946 to be the main person responsible in giving him the orders to determinate all Jews).

On page 39 Eichmanns lawyer writes that Eichmann was in charge of the deportation of the German, French and Czech Jews and that they were transported into Ghettos in 1941 but that Eichmann did not know that the high rank SS and Nazi Police leaders had started executing these Jews. It cannot be proved that the defendant had any influence on these killings...

Part II of the counts of indictment against Adolf Eichmann are the crimes against the Jewish people he was accused of:

1. deportation (of the Jews) into labor camps

2. imprisoning (of the Jews) in Ghettos

3. concentration (of the Jews) in transit camps and other concentration camps.

4. the execution of deportation (of the Jews) under inhuman conditions

The page above is part of a declaration Adolf Eichmann made in Buenos Aires in May 1960 and signed after he was captured from the Israeli secret service, the Mossad. Right after that Eichmanns lawyer writes that this declaration is meaningless because Eichmann was forced to write it. In the delaration it says that Eichmann wants to find his internal peace and is willing to cooperate with the Israeli court. Eichmanns lawyer writes that this is not true, someone who was hiding for 15 years does not have the wish to show up at court all of a sudden...

On this page and the following pages Eichmann's defending lawyer doubts that the court is even the right court to judge Nazis and Nazi helpers and also doubts that the Israeli laws are applicable, dated 14 April 1961.

On the last page (page 76) of the main document Dr. Sevatius is pleading to drop the proceedings against Eichmann and to set him free!

Adolf Eichmann lived under the false name Ricardo Klement for ten years in Buenos Aires, Argentina until Israeli Mossad agents captured him on May 11, 1960 and brought him to Israel.

In January 1942 Eichmann helped Heydrich organize the Wannsee Conference in Berlin during which Heydrich and Eichmann along with 15 Nazi bureaucrats planned the extermination of the entire Jewish population of Europe and the Soviet Union, estimated at 11 million persons.

He was found guilty on all counts, sentenced to death and hanged at Ramleh Prison, May 31, 1962.

A fellow Nazi reported that Eichmann once said "he would leap laughing into the grave because the feeling that he had five million people on his conscience would be for him a source of extraordinary satisfaction."
